Electronic Records and Signature Consent

1. Scope of This Consent

This Electronic Records and Signature Consent (“E-Sign Consent”) governs your agreement to receive, sign, and retain records electronically in connection with your use of the RestAssured platform operated by RestAssured LLC, a Minnesota limited liability company (“RestAssured,” “we,” “us,” or “our”).

This consent applies to all of the following records and communications:

• Account agreements: Terms of Service, Subscription Terms, and any amendments thereto.
• Legal disclosures: Privacy Policy, Cookie Policy, Acceptable Use Policy, Data Processing & Security Statement, Disclaimer, and Accessibility Statement.
• Transactional records: Purchase confirmations, payment receipts, subscription renewals, refund notifications, and invoices.
• Notices: Material changes to policies, service interruptions, security alerts, and other communications required or permitted by law or our agreements.
• Platform-generated documents: Your Gap Analysis PDF, Life Readiness Assessment results, and any documents or records created within EasyVault that you choose to generate or export through the platform.
• Support communications: Responses to support requests submitted through the platform or via email.

This consent does not apply to documents or communications that we are legally required to provide in paper form, or where we otherwise determine that paper delivery is appropriate. We reserve the right to send paper copies of any record at our discretion.

2. How We Deliver Electronic Records

We may deliver electronic records to you by any of the following methods, at our discretion:

• In-app display: Documents and notices presented within the RestAssured web application at app.restassured.life, including during account creation, checkout, and settings flows.
• Email: Documents and notices sent to the email address associated with your RestAssured account.
• Posted to the Legal Hub: Policies and agreements posted at www.restassured.life/legal, which constitute notice when we update the “Last Updated” or “Effective” date and send you a notification email.
• In-app notification: Banner, modal, or push notification within the application directing you to review updated records.

It is your responsibility to maintain a valid email address on your account. If electronic delivery fails because your email address is invalid or your inbox is full, that failure does not invalidate the record or affect your obligations.

3. Electronic Signatures

When you take any of the following actions on the RestAssured platform, your action constitutes a legally binding electronic signature to the same extent as a handwritten signature:

• Clicking “I Agree,” “Accept,” or “Continue”: When presented with an agreement, policy, or consent during account creation, checkout, or a material update flow.
• Checking a consent checkbox: Including checkboxes for this E-Sign Consent, marketing communications, and Terms of Service acceptance.
• Submitting a form or completing a purchase: Submission of payment information and completion of a purchase constitutes your signature on the applicable Subscription Terms and purchase agreement.
• Authenticating and continuing past a disclosure screen: Logging in and proceeding past a full-screen disclosure or updated policy notice constitutes acceptance of the disclosed terms.
• Typing your name in a designated signature field: Where the platform presents a typed-name field for a document or authorization, entering your name constitutes an electronic signature.

RestAssured logs the date, time, IP address, and account identifier associated with each electronic signature event. These records serve as evidence of your consent and agreement.

4. Hardware and Software Requirements

To access, view, and retain electronic records from RestAssured, you must have the following minimum hardware and software. It is your responsibility to ensure that your system meets these requirements before consenting and on an ongoing basis.

If the hardware or software requirements change in a way that creates a material risk that you will be unable to access electronic records, we will notify you and provide instructions for updating your settings or requesting paper copies.

5. Your Right to Withdraw Consent

You have the right to withdraw your consent to receive electronic records at any time. Withdrawal is prospective — it does not affect the legal validity of any electronic records or signatures made prior to your withdrawal.

To withdraw consent, you may:

• Email us: Send a written withdrawal request to legal@restassured.life from the email address associated with your account, with the subject line “E-Sign Consent Withdrawal.”
• Contact support: Submit a request through the support portal at www.restassured.life or by emailing support@restassured.life.

There is no fee to withdraw consent. If withdrawal causes you to lose access to platform features, any prepaid subscription amounts may be subject to our Refund Policy.

6. Updating Your Contact Information

To ensure you receive electronic records, you must keep your email address current. You may update your email address at any time in your account settings at app.restassured.life/settings, or by contacting support@restassured.life.

When you update your email address, we will send a verification message to the new address. The new address will become your record-delivery address once verified. Until verification is complete, electronic records will continue to be sent to your previous address.

7. Requesting Paper Copies

You have the right to request a paper copy of any electronic record we have provided to you. To request a paper copy:

• Email: Send your request to legal@restassured.life, identifying the specific document(s) you need in paper form.
• Mail: Send a written request to RestAssured LLC, 985 Lake Street, #1024, Wayzata, MN 55391.

We will fulfill paper copy requests within ten (10) business days of receipt. We reserve the right to charge a reasonable fee to cover printing and postage costs for paper copies. We will disclose any applicable fee before processing your request and will not fulfill the request without your confirmation.

Requesting a paper copy of a specific record does not constitute withdrawal of your E-Sign Consent. If you wish to withdraw consent entirely, follow the process described in Section 5.

8. Retaining Electronic Records

We recommend that you save and/or print copies of all electronic records for your own records. You may download electronic records from the platform during your active subscription. Your responsibilities regarding record retention:

• Download promptly: Platform-generated documents (e.g., your Gap Analysis PDF, EasyVault exports) should be downloaded and saved by you. RestAssured retains platform data in accordance with our Data Processing & Security Statement, but is not a permanent archive service.
• After account closure: Following account closure, your ability to access platform-generated documents through the application may be limited or unavailable. Refer to our Data Processing & Security Statement for applicable retention periods.
• Email records: Retain copies of transactional emails and policy notices sent to your registered email address. We recommend maintaining a dedicated folder for RestAssured communications.

RestAssured stores signed agreement records for a minimum of seven (7) years from the date of execution, in accordance with applicable recordkeeping requirements. You may request a copy of your agreement history from legal@restassured.life.

10. Minor and Authorized Representative Accounts

RestAssured is intended for users who are 18 years of age or older. If you are providing consent on behalf of another individual (for example, as a legal representative, power of attorney, or trustee managing an account), you represent and warrant that:

• You have the legal authority to provide E-Sign Consent on behalf of that individual.
• The individual on whose behalf you are acting has authorized you to receive and sign electronic records on their behalf.
• You will ensure that the individual is informed of and can access all electronic records received in connection with their account.

Enterprise account administrators who accept this consent on behalf of an organization represent that they have the authority to bind the organization to electronic records and signatures.

11. Relationship to Other Agreements

This E-Sign Consent is incorporated into and forms part of the RestAssured Terms of Service. By accepting the Terms of Service, you also accept this E-Sign Consent unless you separately withdraw consent in accordance with Section 5. In the event of any conflict between this E-Sign Consent and any other agreement, the terms of this E-Sign Consent govern with respect to the subject matter of electronic records and signatures.

This consent is governed by the laws of the State of Minnesota, consistent with the governing law provisions of the RestAssured Terms of Service.

12. Changes to This Consent

We may update this E-Sign Consent from time to time. If we make a material change, we will notify you by email and/or an in-app notice before the change takes effect. Continued use of the platform after the effective date of a revised E-Sign Consent constitutes your acceptance of the revised terms.

If you do not agree to a revised E-Sign Consent, you must withdraw consent in accordance with Section 5 and cease using the platform.

14. Consent Acknowledgment (In-Application)

The following text is presented to users in the RestAssured application at account creation and at any material update to this consent. Checking the box and clicking “Continue” constitutes the user’s electronic signature and acceptance of this E-Sign Consent.
